CX Pay (“CX Pay,” “we,” or “us “) knows that you care how Personal Information about you is collected, used, shared and stored. “Personal Information” means information which personally identifies you. “Affiliate”, means a company which we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us.

We are committed to protecting our customer’s Personal Information. This Privacy Policy explains what Personal Information we collect about you when you use our CX Pay platform (the “Service“); whom we share it with; and how you can control the collection, correction and/or deletion of Personal Information.

This Privacy Policy should be read along with our Terms of Use posted on our website (“Agreement“) and all other operating rules, policies and procedures and additional terms and conditions published on our Website (all of which are incorporated by reference) which governs your use of our Website and Service. Capitalized terms, if not defined in this Privacy Policy, are defined in the Agreement.

CX Pay complies with the data protection frameworks as set forth by the Personal Data Protection Act of Curaçao (2010). CXPay adheres to the industry best practices and is committed to providing its users with sufficient notice, choice, security, data integrity, access, and enforcement of data protection principles and standards.

 

Required Documentation

As part of the required due diligence, CX Pay requires the following documentation for each campaign:

  • Articles of Incorporation
  • Full Name, Email Address, and Telephone number
  • Copy of passport of the Ultimate Beneficiary Owner
  • Chamber of Commerce Excerpt
  • Bank Account Information

 

You may be asked additional (personal) information in order to help validate your identity.

We may obtain address information about you from third party sources, for fraud prevention or for legal compliance.

We may collect Personal Information from you as a result of your email communications with us or your public media posts which we may retain along with our responses. Any Personal Information you publicly post on-line is without any expectation of privacy or confidentiality.

We may also sometimes collect and disclose information about how users use our Website, for example, by tracking unique views received by pages of the Website or the domains from which users originate. This information is not personally identifiable. We may also use “cookies” to track returning users to our Website. A cookie is a piece of software that a Web server can store on the user’s PCs and use to identify the users should they visit the Website again. Information collected may be associated with non-public personal information users provide us through our Website.

 

Information we share with service providers or joint marketers

We may disclose all of the information we collect, as described above, to our Affiliates and to third party entities that perform services on our behalf or with who we partner or are affiliated with in connection with the services we provide to you, including but not limited to financial service provider who provide services to us, those who assist us in preparing and mailing statements (if applicable) and responding to customer inquiries, to those who perform marketing services for us and to financial institutions that are not our Affiliates with whom we jointly offer financial products or services. We use your Personal Information to operate, maintain, and provide to you the Service and conduct our business. For example (and not limited) to:

We may provide your personal information to companies that provide services to help us with our business activities such as processing your payments and offering customer service. How We Store and Protect Your Personal Information

We may store Personal Information in locations outside our direct control (for instance, on servers or databases co-located with hosting providers).

We use Security Sockets Layer (SSL) encryption technology to encrypt sensitive personal information (such as your payment information and geolocation) before it travels over the internet. Credit card numbers are never stored on our database or servers.

The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

 

Compromise of Personal Information

We will promptly notify those persons whose Personal Information have been compromised. Notwithstanding, CX Pay does not accept liability for any unintentional disclosure or a disclosure that occurs due to a security breach of our systems or facilities.

 

User Access and Acceptance

You may, of course, decline to submit Personal Information to us; in which case, you may not be able to become a CX Pay User or use the Service.

If your Personal Information changes, you may correct, update, amend, remove, or ask to have it removed by contacting the email address listed below. If you no longer desire our Service, you may contact us directly. We will respond to your request within two business days.

We will retain your Personal Information permanently; however, we will use your Personal Information for as long as your account is active or as needed to provide you services. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

Changes to Our Privacy Policy

If we make a material change to our privacy policies and procedures as to the collection, use or disclosure of your Personal Information, we will post a notice of those changes on our Website or notify you by email (sent to the email address specified in your account) to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it, prior to the change becoming effective. You are bound by changes to the Privacy Policy when you use the site after those changes have been posted.
